Home Occupation Permit
The intent of the Home Occupation Permit is to provide a mechanism
whereby certain home-based businesses may operate in compliance with the
provisions of the MORRISON ZONING CODE.
Eligibility
A HOME OCCUPATION PERMIT is intended for the operation of a
one-person, non-retail business offering a personal or professional
service. Eligible businesses include, but are not limited to
architect, decorator, seamstress, typist, beautician, telephone sales,
and answering service. Medical and dental services shall not be
eligible for a HOME OCCUPATION PERMIT.
Application and Filing Fee
Individuals seeking a Home Occupation Permit must submit an
application to the city’s Zoning Administrator. A filing fee of
forty dollars ($40.00), plus associated postage costs, shall accompany
all applications for a HOME OCCUPATION PERMIT.
Notice of Request
A written notice of the request shall be sent, by registered mail, to
all property owners of property which is adjacent to, abutting, and
across the street and/or alley from the property in question. Written
notice shall be sent, by regular mail, to the remaining property owners
within the entire block and those properties across the street along
that block. The applicant shall provide the names and addresses all such
property owners.
Determination
The Zoning Administrator shall review the applications and may issue
a permit provided that the following conditions are met:
- The proposed use is necessary and/or desirable to provide a
service, which is in the public convenience and will contribute to the
general welfare of the community.
- The proposed use will not, under the circumstances of the
particular use, be detrimental to the health, safety, or general
welfare of the persons residing or working in the vicinity.
- The proposed use will not be injurious to property values in the
vicinity.
- That no noticeable increase in on-street parking will result from
the operation, nor will any increased traffic hazard occur as a result
of vehicles entering or exiting the premises.
- That the proposed operation shall not involve any retail or
wholesale business, except as such may be incidental to the rendering
of a personal service.
Permit Issuance
- No permit shall be issued without having first provided a ten-day
period for receiving written comments from affected property owners.
- The Zoning Administrator shall determine if a permit will be
issued after considering all written and/or verbal opposition received
from any affected property owner within the ten-day comment period.
- The Zoning Administrator shall issue a permit provided the
applicant has met the conditions herein cited.
- Should the Zoning Administrator deny a permit, the applicant may
file an appeal with the Zoning Board of Appeals.
Records Management
The City Clerk shall keep a record of all permits issued by the
Zoning Administrator.
Non-Transferability
A HOME OCCUPATION PERMIT shall be issued to the business
owner/operator and is a non-transferable use.
